A Chronology of Michigan's Major Reproductive Health Actions
1996
On January 16, the 6th Circuit Court of Appeals continues to enjoin Governor Engler to pay for abortions of Medicaid eligible women and girls in the cases of rape and incest.

In March, the legislature passes PA 124 of 1996, which bans a Medicaid provider from billing separately for services directly related to performing an abortion. The law goes into effect in April 1997.

On May 29, the House passes HB 5889, which bans “partial-birth” abortions, except in the case of life endangerment for the woman. Though the language is vague, the medical procedure it targets is “intact dilation and extraction.” No evidence exists that the procedure has ever been performed in Michigan. The Senate passes an identical measure on June 6.

On June 16, Governor Engler signs HB 5889, PA 273 of 1996, the “partial-birth” abortion ban. The ban goes into effect April 1, 1997.

On June 19, PA 295 of 1996 passes. The Higher Education budget states that the state reduces the appropriations in an equivalent amount for dollars universities spend on insurance coverage for abortion services. However, the Attorney General rules it unconstitutional.

On July 3, PA 352 of 1996 passes and contains language that pregnancy prevention funds cannot be used to provide abortion counseling, referrals or service.

In September, PA 375 of 1996 passes. The amendment bans state employee health care coverage except to prevent the death of the woman. However, the Civil Service Commission never implements this provision.

On November 30, the Senate passes SB 515, which defines certain crimes against prenatal children and provides penalties; abortion performed by a physician is excluded. The bill moves on to the House but dies at the end of the 1996 legislative session.

On December 13, PA 124 of 1996 passes and amends the Social Welfare Act to ban Medicaid funds paying for abortions or related services when part of a managed care plan.
